Terms of Use

These Terms of Use govern your use of Sweat Poker. Please read them before using the app. By downloading or using Sweat Poker, you agree to them. If you do not agree, do not use the app.

Who You Are Agreeing With

Sweat Poker is published by Nordighund LLC. These Terms are between you and Nordighund LLC only, and not with Apple. Nordighund LLC, not Apple, is solely responsible for Sweat Poker and its content. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.

Your License

We grant you a non-transferable license to use Sweat Poker on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you through Family Sharing or volume purchasing. The license is for personal, non-commercial use. You may not sell, rent, sublicense, or redistribute the app, or attempt to derive its source code except where that restriction is prohibited by law.

Your Multiplayer Name

Sweat Poker has no accounts and no sign-in. To publish a workout you choose a name, which the app generates for you and you can change at any time. That name is shown publicly next to everything you publish. You are responsible for the name you choose, and you agree not to:

• Use a name that is obscene, hateful, harassing, threatening, or otherwise objectionable.
• Impersonate another person, or use a name that suggests an endorsement or affiliation you do not have.
• Use a name that infringes someone else's trademark or other rights.
• Attempt to defeat the name filter through spelling, spacing, or substitution.

Because names are not tied to an account, we cannot guarantee that a name is uniquely yours, and we cannot restore a name to you.

The Leaderboard

Publishing a workout puts it, your name, your dumbbell weights, your times, and a photo if you choose to add one on a public leaderboard that other players can see and race. Completing a workout that somebody else published also posts your time to that workout's leaderboard. By publishing, you grant Nordighund LLC a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute what you publish within Sweat Poker and on share links for it, for as long as it remains on the board — at most 14 days, after which it and everything published with it, photos included, is deleted.

A photo you add must be of you, taken by you, and not depict anyone else without their consent. Other players can vote on it; that vote is just reaction, not a claim about you or your workout.

Times on the leaderboard are self-reported by the app running on someone's device. We validate what we can, but we do not warrant that any time on the board is accurate or was honestly achieved. You agree not to submit fabricated results or to interfere with the leaderboard, including by automating submissions, tampering with the app, or submitting data other than through Sweat Poker itself.

No Objectionable Content

We have zero tolerance for objectionable content on the leaderboard — in a name or in a photo. You may not publish anything that is:

• Obscene, pornographic, or sexually explicit.
• Hateful, or that demeans or attacks a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender, gender identity, sexual orientation, or age.
• Harassing, bullying, threatening, or intended to intimidate another person.
• Violent, or that encourages self-harm or dangerous behavior.
• Illegal, or that promotes illegal activity.
• Spam, advertising, or an attempt to drive people to another service.

Names are checked automatically before they are accepted, but no filter is perfect, and the rule above applies regardless of whether the filter caught something.

Reporting and Enforcement

Any entry on the leaderboard can be reported from inside the app. Entries that enough people report are hidden automatically pending review. We review reports and act on objectionable content, and we aim to do so within 24 hours of a report.

We may remove any published workout or entry at any time, with or without notice, and we may block a device from publishing further workouts. A device whose entry has been removed for objectionable content is blocked from publishing again. Blocking a device does not stop you using the rest of the app. If you believe we have removed something in error, email [email protected].

Health and Safety

Sweat Poker is a fitness app, not a medical device, and nothing in it is medical advice. The workouts it deals are randomly generated and are not tailored to your fitness level, your injuries, or your health. Consult a physician before starting any exercise program, particularly if you have a medical condition, are pregnant, or have been inactive.

You exercise at your own risk. Stop if you feel pain, dizziness, or shortness of breath, and seek medical attention. Calorie figures shown in the app are rough estimates based on session duration and an average body, not measurements. Racing another player's time is a game — do not push past what is safe for you in order to beat it.

Subscriptions

Sweat Poker Pro is an auto-renewing yearly subscription sold through the App Store. Payment is charged to your Apple Account at confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the end of that period. You can manage and cancel subscriptions in your Apple Account settings after purchase.

The free workouts in Sweat Poker do not expire. Workouts opened from a share link are limited without a subscription; the current limit is shown in the app.

Maintenance and Support

Nordighund LLC is solely responsible for providing any maintenance and support services for Sweat Poker, as required by applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app. For support, email [email protected] or use the support page.

Disclaimer of Warranties

Sweat Poker is provided "as is" and "as available", without warranty of any kind. To the maximum extent permitted by applicable law, Nordighund LLC disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app or the leaderboard will be uninterrupted, error-free, or available at any particular time.

In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of Nordighund LLC.

Some jurisdictions do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

Product Claims

Nordighund LLC, not Apple, is responsible for addressing any claims by you or any third party relating to Sweat Poker or your possession and use of it, including product liability claims, any claim that the app fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property

Sweat Poker, its name, its artwork, and its content are owned by Nordighund LLC and protected by intellectual property law. In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Nordighund LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.

Legal Compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable third-party terms when using the app.

Apple as Third-Party Beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right — and will be deemed to have accepted the right — to enforce these Terms against you as a third-party beneficiary of them.

Termination

You may stop using Sweat Poker at any time by deleting it. We may suspend or end your access to the leaderboard, and remove anything you have published, if you break these Terms. The sections on disclaimers, liability, and governing law survive any termination.

Limitation of Liability

To the maximum extent permitted by applicable law, Nordighund LLC will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, arising out of your use of Sweat Poker, including any injury sustained while exercising. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the twelve months before the claim, which for a free download is zero. Some jurisdictions do not allow these limitations, so some of them may not apply to you.

Changes to These Terms

We may update these Terms from time to time. If we make a material change, we will update the effective date at the top of this page and, where appropriate, notify you in the app. Continuing to use Sweat Poker after a change means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to its conflict of law provisions. Nothing here limits any rights you have under the mandatory consumer protection laws of the country you live in.
